ND CC 49-23: The ND One Call Rules
The ND One Call Board would like it’s stakeholders to be aware that under ND law there are rules in place to handle violations of the One Call Rules and penalties to help enforce those rules.
Under ND Century Code title 49 the ND Public Service Commission is given authority to among other things, hear and settle complaints, impose penalties, assign matters to an administrative law judge and informally handle letters and other informal complaints for most matters covered by title 49.
In brief what does this mean? For the stakeholders (primarily excavators and utility operators) through a written complaint driven process the PSC will hear and rule on complaints involving violations of the one call rules (NDCC 49-23). Violations are considered a class A misdemeanor using authority under 49-07 and the PSC can issue fines up to $5,000 per violation to enforce its decisions.
